The Office of the United States Trade Representative ("USTR") is providing notice that members of the public have an opportunity to view the non-confidential session of the second substantive meeting of the World Trade Organization ("WTO") in the dispute European Communities and Certain Member States--Measures Affecting Trade in Large Civil Aircraft (WT/DS316). At the session, parties will make their opening statements and may pose questions or make comments on the other party's statement. The United States does not expect the Panel to pose any questions or make any comments during the session. The session will be videotaped. At an appropriate time after the session is over, the Panel will confirm that no business confidential information was referenced during the session. Public viewing of the videotape will occur after the conclusion of the second substantive meeting, which will take place July 24-26, 2007. In the case of the first panel meeting, the viewing was held the day after the panel meeting concluded, so the viewing could be as early as July 27. Once the WTO announces the time and date of the public viewing, USTR will post that information on its Web site at www.ustr.gov.

Initiation of Section 301 Investigations: Acts, Policies, and Practices of Certain Economies Relating to Structural Excess Capacity and Production in Manufacturing Sectors

The United States Trade Representative (Trade Representative) has initiated investigations under Section 301 of the Trade Act of 1974 regarding the acts, policies, and practices of certain economies relating to structural excess capacity and production in certain manufacturing sectors. Key trading partners have developed production capacity untethered from the incentives of domestic and global demand. This excess capacity leads to, among others, overproduction and large or persistent trade surpluses, as well as underutilized and unused capacity, in manufacturing sectors. These investigations will focus on economies that appear to exhibit structural excess capacity and production in various manufacturing sectors, such as through large or persistent trade surpluses or underutilized or unused capacity: China, the European Union (EU), Singapore, Switzerland, Norway, Indonesia, Malaysia, Cambodia, Thailand, Korea, Vietnam, Taiwan, Bangladesh, Mexico, Japan, and India. Notice of Actions in Section 301 Investigations of Acts, Policies, and Practices of Various Economies Related to the Failure of Each Economy To Impose and Effectively Enforce a Prohibition on the Importation of Goods Produced With Forced Labor

The United States Trade Representative (Trade Representative) has determined under Section 301(b) and Section 304(a) of the Trade Act of 1974, as amended (Trade Act), that in each of 60 investigations, certain of the acts, policies, and practices of the economy at issue are actionable and that action by the United States is appropriate. In accordance with the specific direction of the President, the Trade Representative is taking actions in each of these investigations by imposing tariffs on all products of the investigated economy, with certain exemptions as provided in Annexes I and II to this notice (Notice). Consistent with the specific direction of the President, for an economy that imposes a forced labor import prohibition, has committed to impose and enforce such a prohibition through an Agreement on Reciprocal Trade (ART), or has imposed a partial regime with the effect of preventing the importation of certain forced labor goods, the Trade Representative has determined 10 percent is the appropriate rate of Section 301 duties, with specific economies subject to a 10 percent rate net of a product's most-favored-nation (MFN) duty. Initiation of Second Four-Year Review Process: China's Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation

The U.S. Trade Representative is commencing the second, statutory four-year review of the two actions taken under Section 301 of the Trade Act of 1974, as amended (Trade Act), in the investigation of China's Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation. The two actions were effective, respectively, on July 6, 2018, and August 23, 2018, and subsequently were modified by imposing additional duties on supplemental lists of products, by the temporary removal of duties on certain products through product exclusions, and through the first, statutory four-year review. The first step in the four-year review process is notifying representatives of domestic industries which benefit from the actions of the possible termination of the actions and of the opportunity for these representatives to request continuation of the actions. Requests for continuation must be received in the 60-day window prior to the second four-year anniversary of the respective action: (1) between May 7, 2026, and July 5, 2026, for the July 6, 2018, action; and (2) between June 24, 2026, and August 22, 2026, for the August 23, 2018, action.
