The Seattle District, Corps of Engineers hereby cancels its Notice of Intent to prepare an Environmental Impact Statement (EIS) as published in FR, Vol. 59, No. 74, page 18373, 18 April 1994. A Draft EIS was finalized in December 1995 for the proposed municipal solid waste landfill. The Notice is canceled because the permit application for the proposed landfill was denied on 30 September 1996 and completion of the Final EIS is not required. The basis for permit denial was that Resource Investments, Inc. failed to clearly demonstrate that there are no less environmentally damaging practicable alternatives for achieving the project purpose; and that the proposed landfill represents an unacceptable risk to public health and safety due to the potential contamination of the Central Pierce County Aquifer System.
