Air Plan Approval; Michigan; Conditional Approval of the Detroit Sulfur Dioxide Nonattainment Area Plan

The Environmental Protection Agency (EPA) is proposing to conditionally approve the State Implementation Plan (SIP) revision submitted by Michigan on December 20, 2022, and supplemented on February 21, 2023, which amends a SIP submission previously submitted to EPA on May 31, 2016 and June 30, 2016, for attaining the 1-hour sulfur dioxide (SO 2 ) primary national ambient air quality standard (NAAQS) for the Detroit SO 2 nonattainment area. If this action is finalized, EPA will propose to convert the conditional approval of the SIP revision to a full approval upon Michigan timely meeting its commitment to submit the issued permits.

Approval of Source-Specific Air Quality Implementation Plan; New York; Big Six Towers Inc.

The Environmental Protection Agency (EPA) is proposing to determine a revision to the State of New York's State Implementation Plan (SIP) for the ozone National Ambient Air Quality Standard (NAAQS) related to a source-specific SIP (SSSIP) revision, for Big Six Towers Inc. (the Big Six), located at 59-55 47th Ave. Woodside, NY 11377 (the Facility), is approvable. The EPA is proposing to find that the control options in this SSSIP revision implement Reasonably Available Control Technology (RACT) with respect to oxides of nitrogen (NO X ) emissions from the relevant Facility sources, which are identified as three oil-fired engines. This SSSIP revision is intended to implement NO X RACT for the relevant Facility sources in accordance with the requirements for implementation of the 2008 and 2015 ozone NAAQS. The EPA proposes to determine that this rulemaking will not interfere with ozone NAAQS requirements and meets all applicable requirements of the Clean Air Act (CAA).

Phasedown of Hydrofluorocarbons: Excluding Road and Intermodal Container Transport Refrigeration Units From the Hydrofluorocarbon Leak Repair Requirements

The U.S. Environmental Protection Agency (EPA) is proposing an exemption for road and intermodal container transport refrigeration units (TRUs) from the leak repair requirements established under the American Innovation and Manufacturing (AIM) Act. In the final rule "Phasedown of Hydrofluorocarbons: Management of Certain Hydrofluorocarbons and Substitutes Under the American Innovation and Manufacturing Act of 2020," the EPA established, among other provisions, leak repair requirements for refrigerant-containing appliances with a charge size of 15 pounds or more that contain a hydrofluorocarbon (HFC) or certain substitutes for HFCs. The EPA intended to exempt refrigerant-containing road and intermodal container TRUs from the leak repair requirements and is issuing this proposal to clarify the applicability of these requirements. The EPA is not proposing other amendments or taking comment on any other aspects of the 2024 "Phasedown of Hydrofluorocarbons: Management of Certain Hydrofluorocarbons and Substitutes Under the American Innovation and Manufacturing Act of 2020."
