Correcting Amendment Reinstating “Grandfather” Exceptions to Restrictions on Private Transfer Fee Covenants; Correction

The Federal Housing Finance Agency published a Final Rule; Technical Amendment document in the Federal Register on March 17, 2026, regarding Correcting Amendment Reinstating "Grandfather" Exceptions to Restrictions on Private Transfer Fee Covenants. The ACTION: line of the Final Rule; Technical Amendment document incorrectly stated that the Final Rule was requesting public comments, however, the Final Rule; Technical Amendment document is not requesting public comments. This correction removes "request for comments" from the ACTION: line of the Final Rule; Technical Amendment document.

Amendment Reinstating “Grandfather” Exceptions to Restrictions on Private Transfer Fee Covenants

The Federal Housing Finance Agency (FHFA) is making a technical amendment to its Private Transfer Fee Covenants (PTFC) Regulation. The PTFC Regulation restricts FHFA's regulated entities-- the Federal National Mortgage Association (Fannie Mae), the Federal Home Loan Mortgage Corporation (Freddie Mac) (collectively, the Enterprises), and the Federal Home Loan Banks (Banks)--from purchasing, investing in, accepting as collateral, or otherwise dealing in mortgages on properties encumbered by certain types of PTFCs, or related securities, subject to certain exceptions. The technical amendment reinstates timing and transitional applicability ("grandfather") exceptions that were removed by FHFA's 2024 amendments to the PTFC Regulation. The reinstated "grandfather" exceptions are applicable nunc pro tunc beginning July 16, 2012.

Notice of Annual Adjustment of the Cap on Average Total Assets That Defines Community Financial Institutions

The Federal Housing Finance Agency (FHFA) has adjusted the cap on average total assets that is used in determining whether a Federal Home Loan Bank (Bank) member qualifies as a "community financial institution" (CFI) to $1,541,000,000, based on the annual percentage increase in the Consumer Price Index for all urban consumers (CPI-U), as published by the Department of Labor (DOL). This change is effective as of January 1, 2026.

Proposed Collection; Comment Request

In accordance with the requirements of the Paperwork Reduction Act of 1995 (PRA), the Federal Housing Finance Agency (FHFA or the Agency) is seeking public comments concerning an information collection known as "Minimum Requirements for Appraisal Management Companies," which has been assigned control number 2590-0013 by the Office of Management and Budget (OMB). FHFA intends to submit the information collection to OMB for review and re-instatement of the control number, which expired on March 31, 2025.
