The Bureau of Consumer Financial Protection (CFPB or Bureau) is publishing this agenda as part of the Fall 2014 Unified Agenda of Federal Regulatory and Deregulatory Actions. The CFPB reasonably anticipates having the regulatory matters identified below under consideration during the period from November 1, 2014, to October 31, 2015. The next agenda will be published in spring 2015 and will update this agenda through spring 2016. Publication of this agenda is in accordance with the Regulatory Flexibility Act (5 U.S.C. 601 et seq.).

Truth in Lending (Regulation Z); Non-application to Earned Wage Access Products

The Consumer Financial Protection Bureau (CFPB) is issuing this advisory opinion to resolve regulatory uncertainty regarding: (1) the applicability of the definition of credit under Regulation Z, which implements the Truth in Lending Act (TILA), to earned wage access (EWA) products that conform to the description of "Covered EWA" provided in part I.C.2 of this advisory opinion; and (2) the applicability of the definition of finance charge under Regulation Z to certain EWA-related charges (expedited delivery fees, tips) to the extent any EWA products meet the Regulation Z definition of credit. The CFPB is also withdrawing a proposed interpretive rule.

Request for Information Regarding Promoting Access to Mortgage Credit

This notice requests information from the public about potential regulatory changes that may reduce regulatory burdens and promote access to mortgage credit, as appropriate and consistent with applicable law. The Consumer Financial Protection Bureau (Bureau or CFPB) seeks to reduce unwarranted regulatory burdens to ensure that creditworthy borrowers can access mortgage credit. Specifically, the CFPB is requesting information on industry and consumer burdens related to the integrated mortgage disclosures under the Truth in Lending Act (TILA) and Real Estate Settlement Procedures Act (RESPA) (TILA-RESPA integrated disclosures or TRID), the right of rescission, and reverse mortgage disclosures.

Privacy Act of 1974; System of Records

In accordance with the Privacy Act of 1974, the Consumer Financial Protection Bureau (CFPB or Bureau) proposes to modify a current Privacy Act System of Records Notice (SORN) titled "CFPB.009- Employee Administrative Records System." This modification introduces a new routine use to permit the disclosure of records to the news media and the public under specific circumstances. The new routine use adopts the same standard applied under the Freedom of Information Act for determining whether information relating to personal privacy interests must be released to the public. In addition, the new routine use is consistent with routine uses adopted by other Federal agencies for systems of records concerning employee personnel files. This SORN enables the CFPB to manage and administer human capital functions related to current and former Bureau employees, volunteers, detailees, applicants, and persons who work at the Bureau, and their named dependents and/or beneficiaries, their named emergency contacts, and individuals who have been extended offers of employment.

Privacy Act of 1974; System of Records

In accordance with the Privacy Act of 1974, as amended, the Consumer Financial Protection Bureau (CFPB or Bureau) proposes to modify a current Privacy Act System of Records titled, "CFPB.019-- Nationwide Mortgage Licensing System and Registry." The system of records allows mortgage loan originators (MLOs) employed by Federal agency regulated institutions to register and submit required information about themselves and their backgrounds in a national registry, and for the administration of the registry.
