Mercedes-Benz USA, LLC \1\ (MBUSA) and its parent company Daimler AG (DAG)(collectively referred to as "MB") have determined that certain model year 2011 and 2012 Mercedes-Benz S-Class (221 platform) passenger cars do not fully comply with paragraph S4.4 TPMS Malfunction of Federal Motor Vehicle Safety Standard (FMVSS) No. 138, Tire Pressure Monitoring Systems. MB has filed an appropriate report pursuant to 49 CFR Part 573, Defect and Noncompliance Responsibility and Reports (dated September 30, 2011). ---------------------------------------------------------------------------
