Agency Information Collection Activities: Submission to OMB for Reinstatement, Without Change, of a Previously Approved Collection; Comment Request

Resumo

The NCUA intends to submit the following information collection to the Office of Management and Budget (OMB) for review and clearance under the Paperwork Reduction Act of 1995 (Pub. L. 104-13, 44 U.S.C. Chapter 35). This information collection relates to 12 CFR part 713 which requires a federal credit union (FCU) to monitor its eligibility to qualify for a higher fidelity coverage deductible and to notify the NCUA if its financial condition changes resulting in the loss of that eligibility for the higher deductible. This information collection notice is published to obtain comments from the public. This requirement enables NCUA to monitor the FCU's financial condition for safety and soundness purposes and helps to assure that FCUs are properly and adequately protected against potential losses due to insider abuse such as fraud and embezzlement.

Request for Information Regarding Enhancing and Streamlining Data Collection From Credit Unions

The National Credit Union Administration (NCUA) is issuing this request for information (RFI) on opportunities to enhance and streamline NCUA's data collections. Specifically, this RFI covers data collected through the 5300 Call Report (Call Report), 5310 Corporate Credit Union Call Report (Corporate Call Report), and Form 4501A Profile (Profile). Through this RFI, the NCUA is soliciting feedback on the key challenges faced by federally insured credit unions (FICUs) as they use these reports and related systems, and any suggestions for improvement. Regulatory Publication and Voluntary Review as Contemplated by the Economic Growth and Regulatory Paperwork Reduction Act of 1996

Purchase, Sale, and Pledge Of Eligible Obligations

This final rule streamlines the NCUA Board (Board)'s regulations governing the purchase, sale, and pledge of eligible obligations. Specifically, the final rule removes the prescriptive lists of items that must be addressed in the written policies adopted by a federal credit union (FCU). Removal of the mandated items will enable a more efficient and principles-based approach. The final rule also removes detailed requirements regarding conflicts of interest and compensation. These regulatory provisions are unnecessary because FCUs are already governed by broader conflict of interest provisions in their bylaws and by the fiduciary duties of their officials. The final rule follows publication of a February 25, 2026, proposed rule and takes into consideration the public comments received on the proposal. After careful consideration of the comments, the Board has decided to adopt the proposed rule without change.

Prohibition on the Use of Reputation Risk

On October 21, 2025, the Board issued its Notice of Proposed Rulemaking to codify the elimination of reputation risk from its supervisory framework. This change aligns with Executive Order 14331, "Guaranteeing Fair Banking for All Americans." Effective September 25, 2025, the NCUA ceased examining for reputation risk. This final rule affirms that the agency will not consider reputation risk--whether alone or in combination with other factors--in supervisory determinations or other decisions, nor will it take adverse actions on that basis.
