Regulatory Agenda

This agenda provides summary descriptions of regulations being developed by the Federal Acquisition Regulatory Council in compliance with Executive Order 12866 "Regulatory Planning and Review, as reaffirmed and amended in Executive Order 13563, "Improving Regulation and Regulatory Review." This agenda is being published to allow interested people an opportunity to participate in the rulemaking process. Additionally, members of the public can track the progress of any open and pending Federal Acquisition Regulation (FAR) rule via the "Open FAR Cases" report, which is publicly available at https://www.acq.osd.mil/dpap/ dars/far_case_status.html. The Regulatory Secretariat Division has attempted to list all regulations pending at the time of publication, except for minor and routine or repetitive actions; however, unanticipated requirements may result in the issuance of regulations that are not included in this agenda. The General Services Administration (GSA) is seeking public comment on the draft of a new General Services Administration Acquisition Regulation (GSAR) clause regarding basic safeguarding of data within Large Language Model Artificial Intelligence Systems (LLMs). Due to the complexity of the issue, GSA is publishing this notification and draft clause to gather feedback from stakeholders before taking future action (e.g., deviation and/or formal rulemaking).

Information Collection; System for Award Management Quarterly Certification of Compliance With Executive Order 14400, Urgent National Action To Save College Sports

Under the provisions of the Paperwork Reduction Act, the Regulatory Secretariat Division will be submitting to the Office of Management and Budget (OMB) a request to review and approve a new information collection requirement regarding a new collection of quarterly certification of compliance with the rules of Executive Order 14400 from registered Higher Education Institutions in the System for Award Management (SAM.gov).

Information Collection; Certain Federal Acquisition Regulation Part 28 Requirements

In accordance with the Paperwork Reduction Act of 1995 and OMB regulations, OFPP, DoD, GSA, and NASA invite the public to comment on an extension concerning certain Federal Acquisition Regulation (FAR) part 28 requirements. OFPP, DoD, GSA, and NASA invite comments on: whether the proposed collection of information is necessary for the proper performance of the functions of Federal Government acquisitions, including whether the information will have practical utility; the accuracy of the estimate of the burden of the proposed information collection; ways to enhance the quality, utility, and clarity of the information to be collected; and ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. OMB has approved this information collection for use through January 31, 2027. OFPP, DoD, GSA, and NASA propose that OMB extend its approval for use for three additional years beyond the current expiration date.
