Abandoned and Incomplete Pesticide Petitions; Policy Statement

EPA is announcing that it will subject to a final review all pesticide petitions for tolerances, exemptions from the requirement of a tolerance, and food or feed additive regulations currently pending with the Agency where the petitioner has failed to respond to a notice of deficiency within 75 days of receipt of the notice. At the time of a final review, pesticide petitions that do not provide sufficient evidence for the Agency to find that the tolerance or exemption is protective of the public health will be denied. The policies reflected in this Statement will be applied by the Agency on a case-by-case basis.
