This is notice in accordance with 35 U.S.C. 209(c)(1) and 37 CFR 404.7(a)(1)(i) that the National Institute of Standards and Technology (``NIST''), U.S. Department of Commerce, is contemplating the grant of a field of use co-exclusive license in the United States to practice the invention embodied in U.S. Patent 5,172,064, titled, ``Calibration System for Determining the Accuracy of Phase Modulation and Amplitude Modulation Noise Measurement Apparatus'' to Femtosecond Systems, Inc., having a place of business in Columbia, Maryland. The patent rights in this invention have been assigned to the United States of America.
