Notice of Proposed Prospective Purchaser Agreement Pursuant to the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as Amended by the Superfund Amendments and Reauthorization Act

Notice is hereby given that a proposed prospective purchaser agreement associated with the Jasper County Superfund Site also known as the Oronogo/Duenweg Mining Belt Site located in Jasper County, Missouri was executed by the Agency on June 29, 1995 and executed by the United States Department of Justice on August 18, 1995. This agreement is subject to final approval after the comment period. The Prospective Purchaser Agreement would resolve certain potential EPA claims under sections 107 and 106 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended by the Superfund Amendments and Reauthorization Act of 1986 (``CERCLA''), against Rogers Iron and Metal Corporation, the prospective purchaser (``the purchaser''). The settlement would require the purchaser to perform cleanup actions at the property which includes grading and leveling surface mine wastes and construction of a retention basin. The purchaser must comply with the institutional controls selected by the EPA and must provide EPA access to the Site.
