EPA Proposes Consent Decree to Address Clean Air Act Allegations

The Environmental Protection Agency (EPA) has proposed a consent decree to establish deadlines for signing notices of final rulemaking in response to a lawsuit filed by the Center for Biological Diversity and Center for Environmental Health under the Clean Air Act. The plaintiffs allege that the EPA failed to meet its non-discretionary duties in determining the attainment status of certain areas with respect to the 2008 ozone National Ambient Air Quality Standards.
