Corporate Average Fuel Economy (CAFE) Preemption

This document proposes to repeal "The Safer Affordable Fuel- Efficient (SAFE) Vehicles Rule Part One: One National Program," published Sept. 27, 2019 (SAFE I Rule), in which NHTSA codified regulatory text and made additional pronouncements regarding the preemption of state and local laws related to fuel economy standards. Specifically, this document proposes to fully repeal the regulatory text and appendices promulgated in the SAFE I Rule. In addition, this document proposes to repeal and withdraw the interpretative statements made by the Agency in the SAFE I Rule preamble, including those regarding the preemption of particular state Greenhouse Gas (GHG) Emissions standards or Zero Emissions Vehicle (ZEV) mandates. As such, this document proposes to establish a clean slate with respect to NHTSA's regulations and interpretations concerning preemption under the Energy Policy and Conservation Act (EPCA).

Event Data Recorders

This final rule amends NHTSA's regulation governing Event Data Recorders (EDR or EDRs) to delay the implementation schedule for expanded pre-crash data capture requirements. In response to petitions for reconsideration of a final rule published on December 18, 2024, the agency is adopting a four-year phase-in compliance schedule that begins September 1, 2028. This action ensures the increased pre-crash data capture requirements are integrated into the vehicle fleet in a manner that aligns with manufacturer production cycles and technical feasibility.

Kawasaki Motors Corp., U.S.A., Receipt of Petition for Decision of Inconsequential Noncompliance

Kawasaki Motors Corp., U.S.A. (Kawasaki) has determined that certain model year (MY) 1979-1981 and MY 2017-2025 Kawasaki motorcycles do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 122, Motorcycle Brake Systems. Kawasaki filed a noncompliance report dated November 4, 2025, and subsequently petitioned NHTSA (the "Agency") on November 5, 2025, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety. This document announces receipt of Kawasaki's petition.

Administrative Rulemaking, Guidance, and Enforcement Procedures

This final rule reinstates and expounds upon procedural reforms for the Department's rulemakings, guidance documents, and enforcement actions rescinded by a final rule published by the Department on April 2, 2021, "Administrative Rulemaking, Guidance, and Enforcement Procedures." Accordingly, this final rule revises and updates the Department's internal policies and procedures relating to the issuance of rulemaking documents. In addition, this final rule updates the Department's procedural requirements governing the review and clearance of guidance documents, and the initiation and conduct of enforcement actions, including administrative enforcement proceedings and judicial enforcement actions brought in Federal court.
