EPA Proposes Settlement Agreement to Address Lawsuit Over RICE NESHAP Rule
The US Environmental Protection Agency (EPA) has proposed a settlement agreement to address a lawsuit filed by the Engine Manufacturers Association, which challenges the EPA's revised National Emission Standards for Hazardous Air Pollutants for Reciprocating Internal Combustion Engines (RICE NESHAP) rule, filed in the US Court of Appeals for the District of Columbia Circuit (Case No. 10-1331). The proposed agreement aims to revise the RICE NESHAP rule to allow owners and operators of certain spark-ignition engines to prove compliance with a formaldehyde emission standard through approved testing, with a proposed effective date of June 15, 2012.
