EPA Denies Petition to Modify Overburden Definition for Toxic Chemical Reporting
The Environmental Protection Agency (EPA) has denied a petition to expand the definition of 'overburden' to include both consolidated and unconsolidated material, which would affect reporting requirements under the Emergency Planning and Community Right-to-Know Act of 1986 and the Pollution Prevention Act of 1990. The decision was made after EPA concluded that consolidated rock often contains toxic chemicals in significant quantities.
