Proposed Rules for Administrative Hearings Under ERISA Section 3(40)(A) Regarding Collective Bargaining Agreements

The U.S. Department of Labor is proposing rules for administrative hearings to determine whether employee welfare benefit plans meet the exception for collective bargaining agreements under the Employee Retirement Income Security Act of 1974 (ERISA). The proposed rules would apply to situations where a state has asserted jurisdiction over a plan that claims to be exempt from state regulation due to its collective bargaining agreement status.
