Well-grounded Claims

The Department of Veterans Affairs (VA) is proposing to amend its adjudication regulations concerning a claimant's statutory responsibility to support his or her claim with adequate evidence to make the claim ``well grounded.'' The proposed rule also addresses VA's duty to help claimants who have filed well-grounded claims obtain evidence pertinent to their claims. The intended effect of this amendment is to establish clear guidelines regarding the types of evidence that make a claim well grounded; VA's duty to help claimants obtain evidence; and exceptions to the well-grounded claim requirement.
