Implementation of Amendments to the Equal Access to Justice Act in Commission Proceedings

The Federal Mine Safety and Health Review Commission is publishing final revisions to its rules regarding the award of attorney's fees and other expenses under the Equal Access to Justice Act (EAJA) for eligible individuals and entities involved in administrative proceedings before the Commission. The revisions, in response to EAJA amendments enacted in 1996, expand the definition of a 'party' eligible for an award and increase the maximum hourly rate for attorney's fees to $125.
