Guidance on Identification of Lead-Based Paint Hazards

Section 403 of Title IV of the Toxic Substances Control Act (TSCA), requires EPA to promulgate regulations that ``identify. . .lead-based paint hazards, lead-contaminated dust and lead-contaminated soil.'' While EPA is in the process of developing section 403 rules, it has issued information designed to serve as guidance until the promulgation of those rules. This guidance was originally issued in a July 14, 1994 memorandum from Lynn R. Goldman, Assistant Administrator for Prevention, Pesticides and Toxic Substances, entitled ``Guidance on Residential Lead-Based Paint, Lead-Contaminated Dust, and Lead- Contaminated Soil.'' Subsequently, copies of the guidance have been available from the Agency upon request. In order to further disseminate the guidance, the Agency is publishing the full text of that document in this notice.
