Multiple Tube Mine and Shell Fireworks Devices
The Commission is proposing to amend its fireworks regulations to require that multiple tube mine and shell devices that have any tube with an inner diameter of 1.5 inches (3.8 cm) or greater pass a performance test for stability. Specifically, these devices would be required to have a minimum tip angle above 60 degrees. Requirements currently enforced by the Commission do not adequately address the risk of injury posed by the potential tipover of these fireworks devices, and labeling would not adequately reduce the risk. Although a voluntary standard exists, the Commission does not believe that it would adequately reduce the risk of tipover or that compliance would be adequate. The Commission is issuing this proposed rule under the authority of the Federal Hazardous Substances Act. The Commission is not proposing any action on multiple tube devices having an inner diameter of less than 1.5 inches.
