US Department of Labor Proposes Changes to Employee or Independent Contractor Status Under Key Labor Laws

The US Department of Labor is proposing to update its analysis for determining employee or independent contractor status under the Fair Labor Standards Act, Family and Medical Leave Act, and Migrant and Seasonal Agricultural Worker Protection Act, effectively rescinding a current rule and replacing it with a modified version from a prior final rule published in 2021.
