Federal Highway Administration Proposes Revision to Memorandum of Understanding with California, Transferring Environmental Responsibilities

The Federal Highway Administration (FHWA) and the State of California are proposing a revised Memorandum of Understanding (MOU) that would extend the duration of use by three years and transfer environmental responsibilities to the State, including authority under the National Environmental Policy Act (NEPA) for certain categorical exclusions (CEs). The proposed changes include modifications to the submission of CE determinations and the notice period for reversion of Federal responsibility.
