EPA Approves Delegation of Authority to NJDEP for MSW Landfills

The Environmental Protection Agency (EPA) is approving a delegation of authority to the New Jersey Department of Environmental Protection (NJDEP) to implement and enforce Federal Plan Requirements for Municipal Solid Waste (MSW) landfills that commenced construction before July 17, 2014. The EPA has signed a Memorandum of Agreement (MoA) with NJDEP, effective November 28, 2023, transferring primary implementation and enforcement responsibilities from the EPA to NJDEP.
