Proposed Settlement Agreement, Clean Water Act and Administrative Procedure Act Claims

The Environmental Protection Agency (EPA) is seeking public input on a proposed settlement agreement to resolve Gunpowder Riverkeeper v. Regan, et al., a lawsuit alleging EPA's approval of Maryland's PCB TMDLs for the Gunpowder and Bird Rivers was arbitrary and capricious. The proposed settlement agreement aims to resolve claims under the Clean Water Act and Administrative Procedure Act.
