Determination of Overfishing or an Overfished Condition

The National Marine Fisheries Service (NMFS) has determined that Atlantic bigeye tuna is still overfished, requiring a notice to be provided by NMFS on behalf of the Secretary of Commerce. This notice is mandated by law whenever NMFS determines that a fish stock or complex is overfished or approaching overfishing conditions.
