Request for Comments; CISS Expansion

On November 15, 2021, Congress passed the Bipartisan Infrastructure Law (BIL). Under Sec. 24108(e) Congress authorizes the Secretary of Transportation to enhance the collection of crash data by upgrading the Crash Investigation Sampling System (CISS) to include-- (1) additional program sites; (2) an expanded scope that includes all crash types; and (3) on-scene investigation protocols. The NHTSA is conducting a comprehensive review of the Crash Investigation Sampling System (CISS) sample design and data collection methods as part of a major effort to upgrade CISS. Users of CISS and other crash data may comment as to the future utility of current CISS, recommend ways to upgrade current CISS, and indicate their anticipated data needs. All comments should be submitted via Docket number NHTSA-2023-0016.

Event Data Recorders

This final rule amends NHTSA's regulation governing Event Data Recorders (EDR or EDRs) to delay the implementation schedule for expanded pre-crash data capture requirements. In response to petitions for reconsideration of a final rule published on December 18, 2024, the agency is adopting a four-year phase-in compliance schedule that begins September 1, 2028. This action ensures the increased pre-crash data capture requirements are integrated into the vehicle fleet in a manner that aligns with manufacturer production cycles and technical feasibility.

Administrative Rulemaking, Guidance, and Enforcement Procedures

This final rule reinstates and expounds upon procedural reforms for the Department's rulemakings, guidance documents, and enforcement actions rescinded by a final rule published by the Department on April 2, 2021, "Administrative Rulemaking, Guidance, and Enforcement Procedures." Accordingly, this final rule revises and updates the Department's internal policies and procedures relating to the issuance of rulemaking documents. In addition, this final rule updates the Department's procedural requirements governing the review and clearance of guidance documents, and the initiation and conduct of enforcement actions, including administrative enforcement proceedings and judicial enforcement actions brought in Federal court.
