Request for Comments on Discretion to Institute Trials Before the Patent Trial and Appeal Board

The United States Patent and Trademark Office (USPTO) is seeking public comment on instituting trials before the Patent Trial and Appeal Board (PTAB) under the Leahy Smith America Invents Act (AIA). The USPTO extended the public comment period until December 3, 2020, following the initial October 20, 2020, publication in the Federal Register.
