Proposed Agreement and Order on Consent for Certain CERCLA Response Activities by Tenant as Bona Fide Prospective Purchaser

The Environmental Protection Agency (EPA) and Planetary Ventures, LLC (PV), a Delaware-based company, have proposed a settlement under the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA) for certain response activities at the former NAS Moffett Field Superfund site in California. PV, which represents itself as a bona fide prospective purchaser, will conduct a pilot study and potentially a removal action at Hangar One, while also paying EPA oversight costs.
