U.S. District Court Remands FinCEN Final Rule on FBME Bank, FinCEN Responds to Comments

The U.S. District Court for the District of Columbia has remanded the final rule imposing a prohibition on correspondent accounts for FBME Bank, Ltd. to FinCEN, citing the agency's failure to meaningfully address FBME's comments on aggregate Suspicious Activity Report data, which challenged FinCEN's interpretation of SAR data on multiple grounds. FinCEN has since provided further explanation in response to FBME's comments.
