EPA Proposes Rule to Allow Refiners to Use Alternative Defense for Ultra-Low Sulfur Diesel and Gasoline Benzene

The Environmental Protection Agency (EPA) is proposing a rule that would give refiners, importers, and retailers of ultra-low sulfur diesel and gasoline the option to use an alternative affirmative defense if their fuel samples exceed the sulfur standard at retail facilities. This move aims to provide a more flexible approach to compliance with diesel sulfur regulations, while also giving small refiners a chance to generate gasoline benzene credits.
