EPA Issues Rule to Allow Refiners to Use Alternative Defense for Ultra-Low Sulfur Diesel and Gasoline Benzene

The Environmental Protection Agency (EPA) is issuing a direct final rule to amend the diesel sulfur regulations, allowing refiners, importers, distributors, and retailers of highway diesel fuel to use an alternative affirmative defense if they meet certain conditions, and amending the gasoline benzene regulations to allow disqualified small refiners to generate credits.
