Waivers for State Innovation Under the Affordable Care Act
The U.S. Department of Health and Human Services and the U.S. Department of the Treasury have the authority to approve state proposals to waive specific provisions of the Affordable Care Act (ACA) under Section 1332, which requires the waiver to provide comparable coverage, be at least as comprehensive and affordable, and not increase the federal deficit. State Innovation Waivers became available on January 1, 2017, and can be approved for up to 5 years, with the option to renew.
