Railroad Safety Enforcement Procedures: Appeal and Hearing Procedures for Rail Routing Decisions
The Federal Railroad Administration (FRA) is establishing procedures for railroad carriers to challenge rail routing decisions made by the Associate Administrator for Safety, which are linked to the Pipeline and Hazardous Materials Safety Administration's (PHMSA) rule requiring enhanced safety and security measures for shipments of explosive, toxic by inhalation, and radioactive materials. The new procedures will enable carriers to analyze safety and security risks, assess alternative routes, and select the most secure options.
