EPA Exempts Bacillus Thuringiensis Proteins from Tolerance Requirements for Corn Use

The Environmental Protection Agency (EPA) has established an exemption from the requirement of a tolerance for residues of Bacillus thuringiensis Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production in corn, allowing its use as a plant-incorporated protectant on corn, field, sweet corn, and pop corn. Mycogen Seeds, a subsidiary of Dow AgroSciences LLC, submitted a petition to the EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), to eliminate the need for a maximum permissible level for these residues.
