FCC Clarifies Section 272(f)(1) Sunset Provisions for BOC Separate Affiliate Requirements
The Federal Communications Commission (FCC) has issued a document clarifying the scope of the sunset provisions for the separate affiliate requirements of the Bipartisan Budget Act of 1997, which apply to the provision of in-region, interLATA telecommunications services by the Bell Operating Companies (BOC). The FCC concludes that the meaning of section 272(f)(1) is unclear and interprets it as requiring a state-by-state sunset of the separate affiliate and related requirements, consistent with the Act's structure and the authorization provisions in section 271.
