Federal Acquisition Regulation to Implement Performance-Based Contracting for Services

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council have agreed on an interim rule to amend the Federal Acquisition Regulation, allowing government agencies to treat performance-based contracts for services as commercial items, and requiring agencies to report on these contracts, in accordance with the National Defense Authorization Act for Fiscal Year 2004.
