USEPA Proposes Prospective Purchaser Agreement for Midwest Portland Cement Superfund Site
The U.S. Environmental Protection Agency (USEPA) is proposing a deal to transfer ownership of the Midwest Portland Cement Superfund Site in Ohio to a buyer who will purchase the property through a court sale, resolving liability under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The buyer will pay $350,000 to reimburse USEPA for response costs in exchange for a covenant not to sue and protection from contribution claims.
