Federal Preempts Tennessee's Hazardous Waste Transporter Fee and Reporting Requirements

The federal hazardous material transportation law preempts Tennessee's requirement for hazardous waste transporters to pay a $650 per year remedial action fee, as it is deemed unfair and unrelated to hazardous material transportation. The law also preempts a requirement for transporters to submit written reports of hazardous waste discharges during transportation, as it differs substantively from the RSPA's requirement under the Hazardous Materials Regulations.
