Longshoring, Marine Terminals, and Gear Certification

The Occupational Safety and Health Administration (OSHA) comprehensively revised its Safety and Health Regulations for Longshoring and those parallel sections of its Marine Terminals Standard with the publication of a final rule in the Federal Register on July 25, 1997. These rules address cargo handling and related activities conducted aboard vessels (the Longshoring Standard) and landside operations at marine terminals (the Marine Terminals Standard). The final rule contained typographical and other errors. This document corrects those errors. This document also corrects several cross-references to the rules that are found in the rules on gear certification. These cross-references are changed because the referenced section numbers have changed as a result of the revisions to the longshoring and marine terminals rules.

Cranes and Derricks in Construction: Railroad Roadway Work

OSHA is revising the standard for cranes and derricks in construction to provide specific exemptions and clarifications with regard to the application of the standard to cranes and derricks used for railroad roadway work. These exemptions and clarifications recognize the unique equipment and circumstances in railroad roadway work and reflect the preemption of some OSHA requirements by regulations promulgated by the Federal Railroad Administration (FRA). The revised standard provides a clearer understanding of which regulatory requirements are applicable, resulting in a more effective regulatory program and ultimately improved safety.

STP Nuclear Operating Company; Application for Permanent Variance and Interim Order; Grant of Interim Order; Request for Comments

In this notice, OSHA announces the application of STP Nuclear Operating Company (STP Nuclear) for a permanent variance and interim order from the provision of OSHA standards that regulate the ensuring of isolation of permit-required confined spaces and presents the agency's preliminary finding to grant the permanent variance. OSHA also announces the grant of an interim order in this notice. OSHA invites the public to submit comments on the variance application to assist the agency in determining whether to grant the applicant a permanent variance based on the conditions specified in this notice of the application.

Occupational Exposure to Beryllium and Beryllium Compounds in Construction and Shipyard Sectors

OSHA is amending its existing construction and shipyard standards for occupational exposure to beryllium and beryllium compounds to clarify certain provisions and simplify or improve compliance. These changes are designed to accomplish three goals: to more appropriately tailor the requirements of the construction and shipyards standards to the particular exposures in these industries in light of partial overlap between the beryllium standards' requirements and other OSHA standards; to aid compliance and enforcement across the beryllium standards by avoiding inconsistency, where appropriate, between the shipyards and construction standards and recent revisions to the general industry standard; and to clarify certain requirements with respect to materials containing only trace amounts of beryllium. This final rule does not affect the general industry beryllium standard.
