OTS Proposes Rule Changes to Clarify Guaranty and Letter of Credit Regulations

The Office of Thrift Supervision is proposing amendments to its regulations to allow Federal savings associations to act as guarantors and issue letters of credit, while also imposing restrictions on suretyship and guaranty agreements based on safety and soundness standards. The OTS is seeking public comment on potential new regulations regarding escrow authority.
