FDA Proposes Changes to Medical Device Preemption Regulations

The FDA is proposing to clarify its position on preemption of state and local requirements for medical devices, stating that available legal remedies, including state common law tort claims, are generally not preempted under the Federal Food, Drug, and Cosmetic Act.
