Montana Associated Physicians, Inc., et al.; Prohibited Trade Practices, and Affirmative Corrective Actions

In settlement of alleged violations of federal law prohibiting unfair or deceptive acts or practices and unfair methods of competition, this consent order prohibits, among other things, two Montana-based organizations from entering or attempting to enter into any agreement with physicians to: Negotiate or refuse to deal with any third-party payer; determine the terms on which physicians deal with such payers; or fix the fees charged for any physician's services. In addition, the consent order prohibits the respondents from advising physicians to raise, maintain or adjust the fees charged for their medical services, or encouraging adherence to any fee schedule for physician's services.
