Policy Regarding Airport Rates and Charges

This document announces Department of Transportation (``Department'') policy on the fees charged by Federally-assisted airports to air carriers and other aeronautical users. The statement of policy (``Final Policy'') was required by the Federal Aviation Administration Authorization Act of 1994, Public Law 103-305 (August 23, 1994). This statement of policy replaces in its entirety the statement of policy published in the Federal Register on February 3, 1995 (``Interim Policy''). This statement of policy incorporates a substantial modification in the approach of the Interim Policy to determining the reasonableness of fees for facilities other than the airfield and public use roadways. In other respects, the approaches of the two policies are similar. The Department proposed the referenced modification in a notice published in the Federal Register on September 8, 1995 (``Supplemental Proposed Policy''). The Final Policy is not significantly revised from that proposed in the September 8 notice.
