Secondary Market Transactions on Interstate Natural Gas Pipelines
The Federal Energy Regulatory Commission is issuing a notice of proposed rulemaking to revise section 284.243 of the Commission's regulations to improve the efficiency of the Commission's capacity release mechanism and encourage greater use of this mechanism. The Commission is proposing to: make changes in its regulations and policies to improve the operation of the capacity release mechanism; eliminate the prior requirement for competitive bidding; and permit shippers to release capacity, and pipelines to sell interruptible and short-term firm service, at rates above the rate cap when the shipper or pipeline has demonstrated that it does not exercise market power.
