Migrant and Seasonal Agricultural Worker Protection Act

This document proposes regulations to amend the definition of``employ'' under the Migrant and Seasonal Agricultural Worker Protection Act (MSPA). Consistent with Executive Order 12866, which concerns regulatory planning and review (see 58 Fed. Reg. 51735 (Oct. 4, 1993)), this document proposes to amend MSPA regulations to clarify and make easier to understand the definition of ``independent contractor'' and ``joint employment'' under MSPA, with the goal of minimizing the potential for uncertainty and litigation arising from such uncertainty and to better guide the Department's enforcement activities.
