EPA Issues Rule to Implement Mandatory Patent Licenses Under Clean Air Act
The Environmental Protection Agency (EPA) is issuing a rule to ensure compliance with the North American Free Trade Agreement (NAFTA) article 1709(10) regarding mandatory patent licenses under Section 308 of the Clean Air Act (CAA). This rule establishes policies and procedures for EPA to obtain patent licenses from patent owners when a non-complying party needs patented technology to meet CAA standards.
