USPTO Proposes Changes to Patent Rules to Implement Leahy-Smith America Invents Act
The US Patent and Trademark Office is proposing changes to patent rules to align with the Leahy-Smith America Invents Act, which shifts the US patent system from 'first to invent' to 'first inventor to file'. The changes will treat patents and prior art differently, and eliminate certain requirements for prior public use or sale, as well as joint research agreements. The proposed rule changes will also repeal provisions related to statutory invention registrations.
