EPA Announces Alternative Dispute Resolution Procedure for LUST Cooperative Agreements

The Environmental Protection Agency (EPA) has made available a Class Deviation from its dispute procedures for assistance agreements related to Leaking Underground Storage Tank (LUST) cooperative agreements funded under the American Reinvestment and Recovery Act of 2009 (ARRA). This procedure applies to enforcement actions taken by EPA on State cooperative agreements, including suspension of performance and potential termination, if the recipient fails to meet a 35% funding obligation and 15% expenditure requirement within nine months.
