FMCSA Proposes Revision to Guidance for Binding Arbitration Under the Administrative Dispute Resolution Act of 1996

The Federal Motor Carrier Safety Administration (FMCSA) is proposing to revise its guidance on binding arbitration for civil penalty forfeiture proceedings, replacing the 'Night Baseball' format with a new approach where the arbitrator determines the final civil penalty and payment period.
