Records Preservation Program and Appendices-Record Retention Guidelines; Catastrophic Act Preparedness Guidelines

On March 11, 2026, the NCUA (or `agency') published a proposed rule to solicit comments on ways to improve and update the vital records preservation program regulation and accompanying guidelines. Based on the comments received, and upon further consideration of the issues involved, the NCUA Board is publishing this final rule, mostly as proposed, to clarify the purpose of part 749, update the definitions, and remove unnecessary references to recommendations and guidance.

Prohibition on the Use of Reputation Risk

On October 21, 2025, the Board issued its Notice of Proposed Rulemaking to codify the elimination of reputation risk from its supervisory framework. This change aligns with Executive Order 14331, "Guaranteeing Fair Banking for All Americans." Effective September 25, 2025, the NCUA ceased examining for reputation risk. This final rule affirms that the agency will not consider reputation risk--whether alone or in combination with other factors--in supervisory determinations or other decisions, nor will it take adverse actions on that basis.

Suretyship and Guaranty; Segregated Deposit and Collateral

The NCUA Board (Board) is amending its regulations to eliminate prescriptive segregated deposit and collateral requirements for suretyship and guaranty agreements. By removing these requirements, the Board is authorizing federally insured credit unions (FICUs) acting as sureties and guarantors to design products that address member needs while maintaining safety and soundness standards. Federal credit unions (FCUs), and federally insured, state-chartered credit unions (FISCUs) if permitted under state law to act as a surety or guarantor, continue to be subject to other requirements related to these arrangements, including the applicable lending regulations. Dependent Care and Board Member Expense Reimbursement
